LEGAL ARTICULATION FOR SOCIO-ENVIRONMENTAL JUSTICE: GUARANTEE, SUPPORT AND MONITORING OF THE RIGHTS OF TRADITIONAL COMMUNITIES
The actions of Fiocruz and FCT, through the OTSS, aim to provide technical and legal advice through knowledge exchange and dissemination of rights, allowing the appropriation of norms and laws by the directly affected traditional peoples. In addition to knowledge exchange, there is strategic, judicial and administrative litigation, with direct action in the Judiciary and in the administrative spheres to defend the rights of traditional peoples and communities. In the process, dialogue round tables may be held to promote socio-environmental justice, which are temporary mechanisms for citizen participation, providing a space for interaction between representatives of organized civil society and municipal authorities. These round tables seek to promote discussions and agreements on strategic issues that affect the day-to-day life of the PCTs and directly impact their conflicts.
PROBLEM SOLVED
In the Bocaina region, there are hundreds of traditional Caiçara, indigenous and quilombola communities that, over the years, have faced threats from land grabbers, large-scale developments and conflicts with conservation units. These threats have generated countless conflicts and lawsuits over land and resources, violating rights and expelling traditional peoples from their territories. These communities lack the means to obtain qualified legal advice and active listening, which are essential to transforming these conflicts and ensuring the protection of their rights.
SOLUTION ADOPTED
The work involves several administrative and judicial processes, assuming various roles, such as amicus curiae in some cases and as an interested party in others. In addition, there is active participation in management councils of Conservation Units (UCs) and in public hearings, with the aim of pressuring the Government to act in accordance with the demands of Traditional Peoples and Communities (PCTs). Periodic meetings are held in the communities to raise demands and provide essential support for defenses.
RESULT ACHIEVED
Reversal of preliminary decisions to expel traditional peoples from their lands; exclusion of judicial financial executions by the Public Authorities against residents' associations of PCTs; monitoring of the disaster situation in Aventureiro - Ilha Grande; launching of consultation protocols; systematization of conflicts.
